If you are having difficulty collecting child support from your child(ren)’s other parent, whether it is a spouse, former spouse, or a biological parent, you may have the option of having the State’s Attorney’s Office of your county represent you and obtain not only future child support, but collect on the back-due child support (arrearage or delinquent support). The State’s Attorney may be able to assist you in establishing paternity, setting child support, and enforcing child support orders already entered by the court.
If you believe you are owed back due child support, call your county State’s Attorney’s Office first. Ask to speak with someone in the domestic relations division or child support enforcement division.
You have the option of retaining private counsel for child support issues; however, private attorney’s typically will not take pro-bono cases (work for free). Some attorney’s will use a sliding scale fee arrangment.
