Legal Separation
Legal separation does not occur until there is a judicial finding and Judgment. While you and your spouse may be living in separate residences, you are not “legally separated”.
Unlike the separation period for no-fault divorce, you do have to be physically living in separate residence before a Judgment for Legal Separation may be entered.
