Uncontested Divorce
An uncontested divorce in Illinois does NOT mean you and your spouse both want a divorce. Just because you and your spouse want a divorce that doesn’t mean you’ve agreed on how the assets, liabilities, and issues with your children are agreed upon.
In order to have a truely “uncontested divorce” all the terms of the divorce have to be agreed to by each of you. I’ve had many clients come into the office over the years believing they had an “uncontested divorce” only to later realize they didn’t agree on what to do with the house, who was going to pay what debts, or who had what parenting rights with respects to the children.
I’ve tried to provide information on this web-site to at least help you and your spouse identify the issues that need to be resolved so the two of you can get as much worked out ahead of time before contacting an attorney and incurring fees. That said, just because every minute detail hasn’t been fully worked out doesn’t mean your case has to be litigated. There have been times where simply at the initial consultation I can provide some ideas that can help the two of you figure out the rest. NO, I do not meet with both parties. NO, I don’t resolve your issues at the initial consultation. I can merely take the parts of your case that have been worked out and provide some suggestions for you to go home and talk to your spouse about. If you still can’t work them out, I can refer you to a mediator to help with the final tweaks.
