In the simplest scenario, all property owned by a married couple is part of the marital estate and will be divided equally upon divorce. Other factors, however, can play a part. For example:

  • Did one spouse own property before the marriage or inherit property during the marriage? Does a prenuptial agreement exist? It is possible that some property is not part of the marital estate and can be retained by just one spouse.
  • Was some property that was not within the marital estate co-mingled with marital property and therefore became "transmuted" into marital property?
  • If property was co-mingled/transmuted, what was the donative intent, i.e., did the property owner intend to add his or her property to the marital estate or was it added unintentionally?
