The court will make a determination by looking at a wide range of elements in making its assessment of whether alimony is appropriate, and if so, how much and for how long. Some of those factors include:

  • Need
  • Ability to pay
  • Length of marriage
  • Prior earning history
  • Future earning potential
  • Non-marital property and asset allocation

These factors are fleshed out through investigating deeper details such as both spouses' current incomes and earning potential. A large income disparity after a lengthy marriage is often an effective rationale for the granting of alimony. A shorter marriage in which both parties have similar earning potential is less likely to see an award of alimony being granted.

The courts can also look farther afield and more in depth if need be to create a sufficiently detailed examination of the need or lack of need for alimony. Further, alimony may be structured in a variety of ways. It may be available only during the divorce itself. It may be set to last five years and then to be reviewed. It can also be set permanently.
